Licensee Duties to a Customer or Client in New Mexico

Thinking about buying or selling your house in Albuquerque, Corrales, Placitas, Rio Rancho, or the East Mountains but not sure if you want to work with a Realtor, real estate agent, transaction broker, or real estate broker? Following is a summary of the Realtors Association of New Mexico's standard duties, responsibilities, and ethical principles required of all real estate licensees. Paul Chavez promises:

(1) To be honest and act with reasonable care.

(2) To comply with local, state, and federal fair housing and anti-discrimination laws, the New Mexico Real Estate License Law and the Real Estate Commission Rules and Regulations, and all other appropriate local, state, and federal laws and regulations.

(3) To perform any and all oral or written agreements made with the Licensee's Customer or Client.

(4) To assist the Licensees' Customer or Client in completing the Transaction, unless otherwise agreed to in writing by the Customer or Client. This includes: A) To present of all offers or counter-offers in a timely manner B) To assist in complying with the terms and conditions of the contract and with the closing of the Transaction.

(5) The Licensee acknowledges that there may be issues related to the Transaction that are outside the Licensee's knowledge or expertise and that the Licensee will suggest that the Customer or Client seek expert (such as legal) advice on these matters.

(6) To promptly account for all monies or property received by the Licensee.

(7) Prior to when the Licensee generates or presents any written document that has the potential to become an Express Written Agreement, written disclosure of (a) any written Brokerage Relationship the Licensee has with any other Parties to the Transaction and/or (b) any material interest or relationship of a business, personal, or family nature that the Licensee has in the Transaction.

(8) To disclose of any adverse material facts actually known by the Licensee about the property or the Transaction, or about the financial ability of the Parties to the Transaction to complete the Transaction. This does not include data from a sex offender registry or the existence of group homes.

(9) To maintain any confidential information learned in the course of any prior Agency relationship unless the former Client's consents to the disclosure or the law requires it.

(10) Unless otherwise stated in writing, a Licensee shall not disclose to their Customer or Client during the transaction that their seller client or customer has previously indicated they will accept a sales price lower than the listed price of a property; that their buyer client or customer has previously indicated they will pay a sales price more than the price submitted in a written offer; the motivation of any party for selling or buying property; that their seller, client, or customer or their buyer client or customer will agree to financing terms other than those offered; or any other information requested in writing by the Licensee's Customer or Client to remain confidential, unless the law requires the disclosure.

Additional Duties to Buyers and Sellers:

Among many other duties, Paul Chavez also provides the following services to a Buyer and/or Seller:

(1) As a Realtor and real estate broker, Paul Chavez has up to date access of every home listed on the market in Albuquerque and surrounding areas, such as Corrales, Placitas, Rio Rancho, Tijeras, and Edgewood, as published by the Southwest Multiple Listing Service (MLS). He will supply the Buyer with a list of homes which meet the Buyer's search criteria and provide individual printouts on each home that the Buyer requests. Paul Chavez will provide the Seller with a current Comprehensive Market Analysis of the Seller's property, sharing all comparable properties in order for Seller to make an informed decision with regards to the listing price.

(2) Paul Chavez will show the Buyer all homes that the Buyer wishes to personally visit.

(3) Paul Chavez will facilitate the Buyer in preparing all documents needed to purchase a property and provide the Buyer copies of all documents. He will facilitate the Seller in preparing all documents needed to list and sell a property and provide the Seller copies of all documents.

(4) He will present the Buyer's purchase offer to the Seller's Listing Agent. If acting as a listing agent, he will present all offers to the Seller.

(5) Paul Chavez will assist the Buyer and/or Seller in any counter-offer paperwork, if needed, and present the documents to the other real estate broker involved in the transaction (if applicable).

(6) He will ensure up-to-date communication with the Buyer and/or Seller on the progress of the transaction.

(7) Paul Chavez will be present during any home inspection performed at the property involved in the transaction and provide and review the inspection reports with the Buyer or Seller in a timely manner.

(8) He will facilitate the proper and timely delivery of all necessary paperwork, including property disclosure statements, inspection reports, appraisals, and surveys.

(9) Paul Chavez will maintain up-to-date communication with the involved Title Company and any other real estate brokers involved in the transaction.

(10) Paul Chavez will be present at the closing and assist the Buyer and/or Seller with any documents that are needed to close the transaction.
